AbstractU ovom radu autorica razmatra teoretski okvir privatnih trgovačkih maraka u suvremenim tržišnim uvjetima, s naglaskom na pravnu zaštitu takvih znakova razlikovanja ovisno o tome jesu li registrirani ili ne. Privatne marke su marke u portfelju trgovaca koji angažiraju proizvođače za proizvodnju proizvoda kojima će marka biti dodijeljena, pa se često nazivaju trgovačkim markama. Kao žig može se zaštititi svaki znak koji se može grafički prikazati, osobito riječi, uključujući osobna imena, crteže, slova, brojke, oblike proizvoda ili njihova pakiranja, trodimenzijske oblike, boje, kao i kombinacije svih naprijed navedenih znakova, pod uvjetom da su prikladni za razlikovanje proizvoda ili usluga jednoga poduzetnika od proizvoda ili usluga drugoga poduzetnika.

Parallel abstract (English)In this paper the author considers the theoretical framework of private commercial labels in the contemporary market, focusing on legal protection of these trade signs depending on whether they are registered or not. Private labels are marks owned by retailers who engage manufacturers to make products to which will become brands, so they are often referred to as commercial labels.A trade mark may consist of any signs capable of being represented graphically, particularly words, including personal names, designs, letters, numerals, the shape of goods or of their packaging, provided that such signs are capable of distinguishing the goods or services of one undertaking from those of other undertakings.
