Public procurement within the meaning of Administrative Procedure Act is a special administrative procedure. It is a case subsidiary implementation lex specialis in administrative areas where there are certain specificities and differences in legal theory that justifies the application of the due institute of administrative law in a way different from the general administrative procedure. Itself public procurement is a set of specific actions prescribed by a special law which preceded the conclusion of the contract, which must implement those that the law calls for taxpayers rights, such as those who spend public funds and are in the public sector. The procedure of public procurement is one of the most detailed standardized special administration of procedures for the Croatian legal system. The reason is that the bonds of public procurement I public bodies that manage public money and the purpose transparentog spending public money lays down the obligation that in the expenditure of funds carried out the compulsory procurement procedure. In Croatia, the public procurement procedure as a special administrative procedure is regulated by the Public Procurement Act. For the Supervision of Public Procurement is responsible, the State Commission for Supervision of Public Procurement. Against the decision of the said national bodies can not be appealed, but an administrative dispute before the Administrative Court of the Republic of Croatian, which assesses the legality of the decision of the State Commission on appeal.
