Abstract
Brak je zakonom uređena životna zajednica žene i muškarca. Sklapa se u građanskom ili vjerskom obliku. Brak prestaje smrću bračnog druga, proglašenjem nestalog bračnog druga umrlim, poništajem ili razvodom. Do poništaja braka dolazi kada nisu ispunjene sve zakonske pretpostavke za valjanost braka. Do razvoda braka dolazi kada su bračni odnosi trajno i teško poremećeni i ako je protekla jedna godina od prestanka bračne zajednice. Postupak razvoda braka pokreće se tužbom ili sporazumnim zahtjevom bračnih drugova. Ako bračni drugovi koji se razvode imaju dijete, moraju sastaviti plan o zajedničkoj roditeljskoj skrbi i ići na obvezno savjetovanje i obiteljsku medijaciju.
Abstract (english)
Marriage is a legally regulated living community between man and a woman. It is entered into by civil or religious ceremony. Marriage can end with the death of one of the partners, pronauncing missing partner dead, with the invalidation or with the divorce. Invalidation of the marriage comes when all the legal assumptions are not fullfilled. Divorce happens when the relations inside the marriage are permenantly disturbed and if the year passed as any kind of relations inside the marriage completly stopped. The divorce starts with a lawsuit or with consensual request of the partners. If the partners that are going through divorce have a child, they need to make a plan about shared parental care and visit obligatory consultments and mediation.
