Abstract
Kao što ljudi imaju pravo na brak kao institut koji je Ustavom zaštićen, imaju pravo i na razvod braka kad očuvanje istog nije moguće. Pri razvodu braka nastaju pravne posljedice ne samo za bračne drugove, već i za njihovu zajedničku maloljetnu djecu, zato je od krucijalne važnosti da zakonodavni okvir za razvod braka bude što bolje postavljen, kako bi ljudi mogli što lakše proći kroz jedno od najstresnijih životnih poglavlja ukoliko do toga dođe. U hrvatskom zakonodavstvu pojam razvoda je razrađen u odredbama Obiteljskog zakona i u ovom radu će se govoriti o osnovnim pojmovima i elementima razvoda kao što su uzroci razvoda braka, vrste razvoda, izvansudski oblici pomoći u rješavanju bračnih sporova, te rješavanje pitanja roditeljske skrbi i ostvarivanja osobnih odnosa s djetetom te njegovog uzdržavanja
Abstract (english)
Just as people are entitled to marriage as an institute protected by the Constitution, they are entitled to divorce when preservation is not possible. Divorce results in legal consequences not only for spouses, but also for their joint underage children, so it is crucial that the legal framework for divorce be set as closely as possible, so that people can easily go through one of the most stressful chapters of life if this happens. In Croatian legislation, the concept of divorce is elaborated in the provisions of the family Act and this paper will discuss basic concepts and elements of divorce such as the causes of divorce, types of divorce, out-of-court forms of assistance in resolving marital disputes, as well as the resolution of parental care issues and the realization of personal relationships with and maintenance of the child.
