Abstract
Država kao subjekt međunarodnog prava označava činjenicu da su države neovisne pravne entitete u međunarodnom sustavu a koje imaju određene prava i obveze. Ovakav koncept temeljen je upravo na načelu suvereniteta a to znači da svaka država ima pravo na nezavisnost i autonomiju kada je riječ o upravljanju unutarnjim poslovima. Države, kao subjekti međunarodnog prava imaju sposobnost da sklapaju međunarodne ugovore, sudjeluju u međunarodnim organizacijama te u diplomatskim odnosima s drugim... More državama. Također, snose odgovornost za poštivanje međunarodnih normi i obveza, uključujući i ljudska prava, zabranu agresije kao i obvezu rješavanja sporova na jedan miran način. Činjenica je ujedno i kako države mogu biti male ili velike, ali imaju jednak pravni status u međunarodnoj zajednici. Prisutni su i neki drugi subjekti međunarodnog prava poput međunarodnih organizacija i entiteta koji su unutar države a koji mogu imati određen status kao i prava u međunarodnom pravu. Važno je svakako spomenuti i činjenicu kako države ne mogu ignorirati međunarodne norme i obveze. Kršenje međunarodnog prava može rezultirati posljedicama koje mogu biti ozbiljnije, uključujući sankcije ili vojne intervencije od strane drugih država kao i međunarodnih organizacija. S obzirom na prirodu međunarodnih odnosa koja je poprilično dinamična, koncept države kao subjekta međunarodnog prava evoluira i prilagođava se izazovima i promjenama u međunarodnom okruženju. Ovdje su uključena i pitanja poput cyber sigurnosti, klimatskih promjena te globalne pandemije koji postaju važnim predmetom međunarodnog pravnog reguliranja. U konačnici, država kao subjekt međunarodnog prava igra ključnu ulogu u međunarodnom sustavu dok njen pravni status kao i odgovornost ima širok utjecaj na međunarodne odnose te suradnju između država diljem svijeta. Abstract (english)
The state as a subject of international law signifies that states are independent legal entities within the international system, endowed with specific rights and responsibilities. This concept is rooted in the principle of sovereignty, meaning that each state has the right to independence and autonomy in managing its internal affairs. States, as subjects of international law, have the capacity to enter into international agreements, participate in international organizations, and engage... More in diplomatic relations with other states. They also bear the responsibility for adhering to international norms and obligations, including human rights, the prohibition of aggression, and the commitment to resolving disputes in a peaceful manner. It is worth noting that states can vary in size, yet they hold an equal legal status in the international community. There exist other subjects of international law, such as international organizations and entities within a state, which may have a designated status and rights in international law. Importantly, states cannot disregard international norms and obligations. Violations of international law can lead to serious consequences, including sanctions or military interventions by other states and international organizations. Given the dynamic nature of international relations, the concept of the state as a subject of international law evolves and adapts to challenges and changes in the international environment. This encompasses issues like cyber security, climate change, and global pandemics, which are becoming pivotal subjects of international legal regulation. Ultimately, the state as a subject of international law plays a crucial role in the international system, and its legal status and responsibilities have a broad impact on international relations and cooperation among states worldwide.
