Freedom of peaceful assembly is a fundamental right protected by international, regional, national and even local legal instruments. Freedom of peaceful assembly is a fundamental human right that can be enjoyed and exercised by individuals and groups. Protecting the freedom of peaceful assembly is essential to create a tolerant and pluralistic society that pursues different identities, while the freedom of peaceful assembly is also recognized as one of the foundations of a functioning democracy to ensure that all people in society have the opportunity to express opinions between civil society, political leaders and government. States have a responsibility to ensure that the right to freedom of assembly is protected, especially when those who assemble are protesting against public policy and challenging the state. The right to peaceful assembly includes the right to freely choose the place and time of assembly, including public streets, roads and squares, and the right to assemble online must also be fully guaranteed. In the Croatian legal system, the right to public assembly is regulated by the provisions of the Constitution of the Republic of Croatia and the Law on Public Assembly. In this way, the right to public assembly in Croatia enjoys the status of a „fundamental“ constitutionally guaranteed right that is guaranteed to be elaborated within the category of „organic law“. Public gatherings in the sense of the Law on Public Gatherings are actually peaceful gatherings and public protests, public events and other forms of gatherings.
