Public procurement is the process that precedes the conclusion of the contract, which must implement those who the law calls for taxpayers rights. The consequence of public procurement is spending of budget funds. Therefore, the transparency of the administrative procedure is very important. In Croatia, the public procurement procedure as a special administrative procedure is regulated by the Public Procurement Act. The Act stipulates, among other things, legal protection in public procurement. This primarily relates to the appeal as a form of administrative dispute. The law prescribes the method of lodging an appeal, deadline for its filing, the contents of the appeal, attachments to the appeal, consumes and compensation procedures and other important provisions. The responsibility of the procedure of public procurement is on the State Commission for Supervision of Public Procurement. Against the decision of that national body can not be appealed, but it is possible to run an administrative dispute before the Administrative Court of the Republic of Croatian, which evaluates the legality of the decision of the State Commission on appeal. This procedure does not suspend the conclusion of public contracts, and it is of urgent nature.
