Abstract
Pitanje međunarodnopravne odgovornosti međunarodnih organizacija bilo je iznimno važno urediti s obzirom na njihov međunarodnopravni subjektivitet. Prihvati li se teza da međunarodne organizacije imaju pravnu osobnost koja je odvojena od osobnosti njihovih članica, to znači da su one sposobne biti nositelji pravaii obveza, ali i da su sposobne prekršiti te obveze te za njih odgovarati. Pretpostavke i ograničenja njihove odgovornosti uredila je Komisija za međunarodno pravo u Nacrtu članaka o odgovornosti međunarodnih organizacija za međunarodno protupravne čine. U Nacrtu je kao pretpostavka međunarodnopravne odgovornosti međunarodne organizacije propisano postojanje međunarodno protupravnog čina kao djelovanja pripisivog organizaciji koje predstavlja povredu neke njezine međunarodnopravne obveze bez obzira na pravni izvor ili narav te obveze.
Abstract (english)
The issue of international legal responsibility of international organizations was extremely important to regulate with regard to their international legal subjectivity. Whether the thesis assumes that international organizations have a legal personality that is separate from the personality of their members means that they are capable of being the holders of obligations, but also being able to break these obligations and respond to them. The assumptions and limitations of their responsibility were regulated by the International Law Commission in the draft Articles on the Responsibility of International Organizations for Internationally Unlawful Compositions. The draft prescribes the existence of an internationally unlawful act as a function of a credible organization as a presumption of international legal responsibility of an international organization, which constitutes a violation of some of its international legal obligation, irrespective of the legal source or nature of that obligation.
