Abstract
Tvrtka je ime trgovačkog društva, obrta i zadruga, dok ustanove nemaju tvrtku, već naziv. Tvrtka je važan element trgovačkog društva s obzirom da se njome definira identitet, odnosno razlikovna svojstva jednog trgovačkog društva u odnosu na druga trgovačka društva i poslovne subjekte. Institut zaštite tvrtke prema zakonskim propisima o trgovačkim društvima osiguran je implementacijom načela tvrtke, a to su načelo istinitosti, jedinstvenosti, stalnosti, zakonitosti, isključivosti i prvenstva.... More Temeljno je pravilo već pri upisu u sudski registar da u isti registar ne smiju biti upisane dvije tvrtke istog ili sličnog naziva. Zakon o trgovini usmjeren je na zabranu nepoštenog tržišnog natjecanja te penalizira povredu tvrtke koja se provodi s ciljem obmanjivanja i dovođenja u zabludu potrošača i javnosti. Problematika zaštite tvrtke i intelektualnog vlasništva u cjelini postaje sve značajnija u uvjetima globalnog gospodarstva te kako zaštita od nepoštenog tržišnog natjecanja postaje sve veći izazov na nacionalnoj, međunarodnoj i globalnoj razini. Abstract (english)
The company is the name of a company, trade and cooperatives, and institutions do not have a company, but the name. The company is an important element of the company with regard to defining her identity or distinctive traits of the company compared to other companies and businesses. Protection of the company under the legal provisions of the companies is secured by the implementation of the principles of the company, namely the principle of truthfulness, unity, continuity, legality,... More exclusivity and priority. The basic rule in the court registration is that in the register may not be entered two companies of the same or similar name. Trade Act aims to ban unfair competition and violation by penalizing businesses that are carried out with the purpose of deceiving and deluding consumers and the public.
