Abstract
Međunarodni sud , glavni sudski organ UN-a kojemu je zadaća rješavanje sporova među državama , te davanje savjetodavnih mišljenja na zahtjev UN-a i drugih za to ovlaštenih međunarodnih organizacija. Sud djeluje u skladu sa Statutom, koji je sastavni dio Povelje UNa. Sve države članice UN-a istodobno su i stranke Statuta, no strankom Statuta može postati i država nečlanica UN-a, ako to odluči Opća skupština UN-a na prijedlog Vijeća sigurnosti. Država koja nije stranka Statuta može iznijeti... More svoj spor pred Međunarodnim sudom ako ispuni uvjete koje za to propisuje Vijeće sigurnosti. Međunarodni sud odlučuje o pravnim sporovima koji se odnose na: tumačenje nekog ugovora,svaku točku međunarodnoga prava,postojanje činjenice koja bi tvorila povredu međunarodne obveze,prirodu ili opseg zadovoljenja koje valja dati za povredu međunarodne obveze. Nadležnost Suda temelji se samo na pristanku stranaka spora, a taj pristanak može biti dan unaprijed. Presude Suda obvezatne su i konačne. Službeni su jezici Suda engleski i francuski. Abstract (english)
The International Court of Justice is the principal judicial organ of the United Nations. The Court’s role is to settle, in accordance with international law, legal disputes submitted to it by States and to give advisory opinions on legal questions referred to it by authorized United Nations organs and specialized agencies. The Court is constituted and functions in accordance with the Statute, annexed to the Charter of the United Nations, of which it forms an integral part.All Members of... More the United Nations are ipso facto parties to the Statute. States which are not members of the United Nations may become parties to the Statute of the Court on conditions to be determined in each case by the General Assembly upon the recommendation of the Security Council. The jurisdiction of the Court in all legal disputes concerns: the interpretation of a treaty, any question of international law, any fact which would constitute a breach of an international obligation, the nature or extent of the reparation to be made for the breach of an international obligation.Only states may be parties in cases before the court, and no state can be sued before the World Court unless it consents to such an action. Any state may consent to the court’s compulsory jurisdiction in advance. The court’s judgment is final and without appeal. The official languages of the Court are English and French.
