Abstract
Izvlaštenje jest institut javnog prava kod kojega javna vlast autoritativnim aktom, utemeljenim na zakonu, a radi ostvarivanja općeg interesa koji mora biti nedvojbeno utvrđen, zahvaća u pravo vlasništva pojedinca uz obvezu davanja pune naknade, a koje se provodi kad je na drugi, blaži način, nemoguće pomiriti javni i privatni interes. Ciljizvlaštenja jest ostvarenje općeg interesa. Zbog toga je i hrvatskim Zakonom o izvlaštenju propisano da se izvlaštenje može provesti kad se ocijeni da će se korištenjem nekretninom za koju se namjerava predložiti izvlaštenje u novoj namjeni postići veća korist od one koja se postizala korištenjem tom nekretninom na dosadašnji način, a to je korištenje od interesa za Republiku Hrvatsku i ne može se postići na način blaži za vlasnika.
Abstract (english)
Expulsion is an institute of public law whereby a public authority based on a law-based authoritative act for the purpose of achieving a general interest which must be undoubtedly determined,concerns the right of individual property with the obligation to give full compensation, which is carried out when in another, milder manner, it is impossible to reconcile public and private interest. The goal of cumming is to realize a general interest. For this reason, the Croatian Expropriation Act stipulates that the expropriation may be carried out when it is considered that the use of real estate for which the expropriation is proposed to be used for new purposes will be greater than the one obtained by using this property in the present way, of interest to the Republic Croatia and can not be achieved in a lazy way for the owner.
