Abstract
Tema ovoga rada je zaštita privatnosti radnika u hrvatskom i europskom pravu. Zaštita privatnosti radnika pojam je s kojim se susrećemo tek u posljednje vrijeme, a rezultat je povijesnih nastojanja i borbi radnika za svoja radnička prava. Naime, radno pravo kao zasebna grana prava pojavilo se tek u 19. stoljeću, kada se izvojilo iz domene građanskog prava. 1910. i 1912. godine u Francuskoj je donesen prvi Zakonik o radu: „Code du Travail“, a još 1825. godine u Engleskoj je ustanovljen prvi radnički sindikat. Dug je put tako trebalo prijeći, a da bi pravo na rad uopće, a posebno zaštita privatnosti pojedinca kao širi pojam i zaštita privatnosti radnika kao uži pojam, postalo jedno od temeljnih ljudskih prava i vrednota, uvrštenih u Ustav Republike Hrvatske i Konvenciju za zaštitu ljudskih prava i temeljnih sloboda koja je obvezujuća za sve zemlje potpisnice, a koje je potpisnik i Republika Hrvatska.
Abstract (english)
The theme of this paper is employees privacy protection in croatian and european law. Employees privacy protection is only recent term and was developed as a result of historical efforts of the workers for their own labor rights. Labor law as a separate branch of law has emerged in 19. st. from the domain of Civil law. In the year of 1910. and 1912. in France was adopted the first Labor Code, also known as: „Code du Travail“ and in 1825. the first labor union was established in England. A long way to go, the right to work as a term, and in particular the right to protect the privacy of an individual as a wider term and to protect the privacy of workers as a narrow term, has become one of the fundamental human rights and values, listed in the Constitution of the Republic of Croatia and the European Convention on Human Rights (ECHR) which is binding on all the signatories, and whose signatory is the Republic of Croatia as well.
