Abstract
Postupak donošenja rješenja u zemljišnoknjižnom postupku odvija se na nadležnom općinskom sudu. Protiv rješenja koje je donijelo nadležno sudstvo u zemljišnokjižnom postupku dopušteni su i prigovor i žalba. Tako se u Zakonu o Zemljišnim knjigama N.N. br. 60. navodi: „Protiv rješenja ovlaštenog zemljišnoknjižnog referenta i sudskog savjetnika nezadovoljna stranka može podnijeti prigovor, a protiv rješenja kojim je odlučeno o prigovoru može podnijeti i žalbu.“ Valja napomenuti da ukoliko se podnesu žalba ili prigovor da oni ne odgađaju samu provedbu upisa, kao i da se ne mogu iznositi neke nove činjenice, prilagati nove isprave ili bilo kakvi drugi prilozi osim u posebnim slučajevima koje propisuje i sam Zakon o zemljišnim knjigama u članku 109. stavka 7., jer je sud nadležan odlučivati o prigovoru i žalbi samo na temelju onakvog činjeničnog i pravnog stanja kakvo je bilo u trenutku zaprimanja, odnosno u trenutku kada je zemljišnoknjižni prijedlog stigao na zemljišnoknjižni sud.Također treba napomenuti da se spominjani prigovor i žalba mogu podnijeti u zakonskom roku od petnaest dana.
Abstract (english)
The procedure for adopting solutions in land registration procedure is carried out in the competent municipal court. Against the decision made by the competent courts in land registration proceedings are admissible and the objection and appeal. Thus, the Law on Land Registry NN no. 60 states: "against the decision of the authorized land registry clerks and court advisor injured party may file a complaint against a decision taken on the complaint may file an appeal." It should be noted that if you file a complaint or objection that they do not delay the implementation of the entry itself, and it could therefore not be some new facts, attach a new document or any other supplements except in special cases prescribed by the law on land registry in Article 109, paragraph 7, because the court competent decide on the objection and appeal only to based onakvog factual and legal situation prevailing at the time of receipt, that is the time when the land registry proposal was received by the land registry court. It should also be noted that the mentioned complaint and an appeal may be submitted within the legal deadline of fifteen days.
