AbstractOvrha na nekretnini poseban je ovršni postupak koji se provodi radi naplate novčane tražbine. Za odlučivanje o prijedlogu za ovrhu na nekretnini i za njezinu provedbu mjerodavan je sud ( mjesna nadležnost) na čijem se području nekretnina nalazi.Sud odmah nakon što donese rješenje o ovrsi mora po službenoj dužnosti Zemljišnoknjižnom odjelu podnijeti prijedlog za upis zabilježbe ovrhe u zemljišnoj knjizi.Ovrha na nekretnini provodi se zabilježbom ovrhe u zemljišnoj knjizi, utvrđenjem vrijednosti nekretnine, prodajom nekretnine i namirenjem ovrhovoditelja iz iznosa dobivenog prodajom. Vrijednost nekretnine utvrđuje se na temelju procjene vještaka i drugih činjenica u visini njezine tržišne cijene na dan procjene.Prodaja nekretnine obavlja se usmenom javnom dražbom. Prodajom nekretnine ovršenik gubi pravo posjeda nekretnine i dužan ju je predati kupcu odmah nakon dostave rješenja o predaji nekretnine kupcu, ako zakonom ili u sporazumu s kupcem nije drukčije određeno.

Parallel abstract (English)Enforcement on immovable property is special enforcement act carried out to collect monetary claims. The court where immovable property is located (territorial jurisdiction) is authoritative for the enforcement ruling of the immovable property and the enforcement proceeding. Once the decision of the enforcement is conducted, the court shall ex officio submit a proposal to the Land Department to registrate a recordation of the enforcement in the land registry. Enforcement on immovable property as a procedure is followed by recordation of enforcement in the land registry and determing the value of the property. Also, enforcement creditor will satisfy his claim from the amount of money taken from the sale of immovable property. Property value is determined on the basis of the evaluation of the experts and some other facts, related to its market price on the date of the valuation. The sale of immovable property is conducted by a public auction. With the sale of immovable property, the enforcement debtor loses his rights on immovable property and is obligated to hand it over to the buyer immediately after a decision to transfer the property is issued to the buyer, unless by the law or with the agreement with the buyer is otherwise specified.
