Abstract
Ljudi od pamtivjeka plove dok je turizam izuzetno mlada grana gospodarstva. Ulaskom plovidbe u turističku djelatnost pojavljuje se nova grana turizma, nautički turizam. Pravno promatrano, plovidba je dobro uređena, turistička djelatnost je također dobro uređena, no plovidba u svrhu turizma je još uvijek suočena s brojnim problemima. Pojavljuje se problem pristupa definiranja nautičkog turizma, a time i zakona koji bi ga regulirali. Naime, nautički turizam se može promatrati kao dio nautike tj. plovidbe ali isto tako ga se može promatrati kao dio turizma. Posljedica te situacije je da nautička struka ne vodi računa o nautičkom turizmu jer ga shvaća kao turističku djelatnost, a turistički djelatnici ga shvaćaju kao nautičku djelatnost. Stoga je nautički turizam, s pravnog stajališta, slabo i prilično konfuzno uređen.
Abstract (english)
People from the immemorial time navigate while tourism is a very young branch of the economy. By entering navigation in the tourism apears a new branch of tourism, nautical tourism. Legally speaking, the sailing is well regulated, the tourism industry is also well regulated, but the navigation for tourism purposes is still faced with many problems. There is a problem of access to the definition of nautical tourism, and therefore the laws that regulate it. The nautical tourism can be seen as part of the nautical ie. navigation but also it can be viewed as part of tourism. The consequence of this situation is that the nautical profession does not takes care of nautical tourism because it is understood as a tourist activity, and tourism professionals understand it as nautical activities. Therefore, the nautical tourism, from a legal point of view, is very poorly and quite confusing arranged.
