Abstract
Još od početka civilizacije ljudi se udružuju iz raznih razloga. Prvenstveno za obranu od neprijatelja, a kasnije razvojem trgovine i proizvodnje, nastaju sve složeniji oblici zajednice i jačanje potreba za udruživanjem. Prve zajednice rimskog prava nisu mogle pratiti potrebe društva, zbog čega se javlja ovaj neformalni oblik udruživanja - ortaštvo. Ortaštvo kao oblik udruživanja nije postojao u osnutku rimske države. Ugovori o ortaštvu nastaju samo kada je potrebno udruživanje bliskih osoba koje nisu članovi iste obitelji ili kada je potrebno financiranje raznih projekata. Ortaštvo je pravna zajednica osoba u kojij se dvije ili više osoba udružuje radi osvarivanja zajedničkog cilja, a koje prestaje ispunjavanjem istog.
Abstract (english)
Since the beginning of civilization, people have socialized for various reasons. Primarily for defense against enemies, and later with the development of trade and production, more and more complex forms of community arise and the need for association increases. The first communities of Roman law could not follow the needs of society, and that is the reason why informal form of association – the partnership appeared. Partnership as a form of association did not exist in the foundation of the Roman state. Partnership agreements are made only when it is necessary to associate close persons who are not members of the same family or when financing of various projects is necessary. A partnership is a legal community of persons in which two or more persons join together to achieve a common goal, which ends when it is fulfilled.
