Abstract
Najprimjereniji način povezivanja europskih država pokazao se model integracije kroz supranacionalne zajednice, a potom i kroz svojevrsnu „uniju“, u kojoj države članice prenose dio svog suvereniteta na supranacionalna tijela Zajednice, ali zadržavaju vlastitu državnost i identitet. Do tad uobičajen put povezivanja država pomoću međunarodnih ugovora pokazao se kao previše nesiguran i neobvezujući oblik suradnje pred izazovima modernog globaliziranog svijeta. U raščlambi pravnog... More sustava Europske unije, najvažnije su tri njegove komponente koje ga čine samostalnim pravnim subjektom sui generis. To su pravna načela na kojima počiva, pravni akti na kojima se temelji te regulatorne ovlasti ili nadležnosti tijela koja stvaraju i provode isti sustav. S obzirom da je pravni sustav Europske unije nadnacionalni pravni sustav, njegova pravna narav i funkcioniranje definiraju se u kontrastu s unutarnjim pravnim sustavom država članica. Zahvaljujući supremaciji prava Unije nad nacionalnim pravima država, omogućena je veća, brža i kvalitetnija zaštita pojedinačnih prava svih u Uniji, te će stoga sigurno doprinijeti većem legitimitetu Unije u očima njenih građana. Abstract (english)
The most appropriate way to connect European states proved to be the model of integration through supranational communities, and then through their own "union", in which member states transfer part of their sovereignty to supranational bodies of the Community, but retain their statehood and identity. Until then, the usual way of connecting states through international treaties proved to be too uncertain and non-binding a form of cooperation in the face of the challenges of the... More modern globalized world. In the analysis of the legal system of the European Union, the most important are its three components that make it an independent legal entity sui generis. These are the legal principles on which it is based, the legal acts on which it is based, and the regulatory powers or competencies of the bodies that create and implement the same system. As the legal system of the European Union is a supranational legal system, its legal nature and functioning are defined in contrast to the internal legal system of the Member States. Thanks to the supremacy of the Union's rights over the national rights of states, greater, faster and better protection of individual rights of all in the Union has been enabled, and will therefore certainly contribute to greater legitimacy of the Union in the eyes of its citizens.
