Abstract
Šteta u građanskom pravu označuje nekakav gubitak, povrjedu koju jedna osoba trpi na subjektivnim pravima i interesima zaštićenima građanskopravnim normama (mimo svoje volje), a koji je odgovorna osoba dužna nadoknaditi. Postoje 4 različite vrste štete: imovinska ili materijalna šteta, neimovinska ili nematerijalna šteta, pozitivna ili obična šteta i negativna šteta ili izmakla korist. Naknada štete podrazumijeva odgovornosti za štetu i načine njezina popravljanja, a popravak štete... More može biti u obliku novčane isplate ili u obliku moralne satisfakcije. Odgovornost za štetu je obveznopravni odnos u kojem je jedna strana dužna popraviti prouzročenu štetu drugoj strani, a druga strana je ovlaštena zahtijevati takav popravak. Odgovornost za štetu ima određene pretpostavke koje su potrebne za nastanak svakog građanskopravnog odnosa. Odgovornost za štetu uređena je Zakonom o obveznim odnosima. Ovaj rad je sastavljen od teorijskog i empirijskog dijela. U teorijskom dijelu rada obraditi će se teorijske postavke koje se tiču samog pojma štete te naknade štete, a u empirijskom dijelu rada biti će obrađen slučaj vezan za sudsku presudu glede naknade štete prema različitim načinima primjene odgovornosti za štetu. Abstract (english)
Damage in civil law means some kind of loss, a violation that one person suffers on subjective rights and interests protected by civil law norms (against his will), and which the responsible person is obliged to compensate. There are four different types of damage: property or material damage, non-property or non-material damage, positive or ordinary damage and negative damage or lost profit. Compensation for damages implies liability for the damage and ways of repairing it, and... More the repair of the damage can be in the form of a monetary payment ori n the form of moral satisfaction. Liability for damage is a legal obligation in which one party is obliged to repair the damage caused to the other party, and the other party is authorized to request such repair. Liability for damage has certain preconditions that are necessary for the emergance of any civil relationship. Liability for damage is regulated by the Law on Obligations. This paper is composed of a theoretical and an empirical part. The theoretical part of the paper will deal with theoretical assumptions concerning the very concept of damages and damages , and the empirical part of paper will deal with a case related to court judgment regarding damages according to different ways of applying liability for damages.
