Abstract
U radu je prikazan građanskopravni aspekt prilikom povrede medicinskog standarda za vrijeme pružanja medicinskih usluga te se ukazuje na različite oblike liječničkih pogrešaka. Kaznena djela protiv zdravlja ljudi usmjerena su u prvom redu na očuvanje zdravlja ljudi, prvenstveno propisivanjem pojedinih ponašanja u okviru pružanja zdravstvene zaštite. Primjenjujući pravila dužne pažnje dolazi do toga da mogući štetnik (liječnik/zdravstvena ustanova) medicinsku uslugu nastoji obavljati u režimu standardne optimalne skrbi,budući da pravni sustav navedeni standard medicinskog postupanja izjednačuje s ekonomskom kategorijom skrbi za pacijenta.
Abstract (english)
The paper presents the civil law aspect od the violation of the medical standard during the provision of medical services and points out the various forms of medical errors. Criminal offenses against human health are primarily aimed at preserving human health,primarily by prescribing certain behaviors within the provision of health care. Applying the rules of due diligence, the potential pest(doctor/health institution) seeks to provide medical services in the regime of standard optimal care, since the legal system equates this standard of medical treatment with the economic category of patient care.
