The European arrest warrant is a judicial decision issued by a Member state of the European Union regarding the arrest and extradition of the person sough by another Member State in order to conduct criminal prosecution the enforcement of the penalty of law or detention measures. The decision was passed on June the 13th of 2002 as part of the Framework decision on the European arrest warrant and surrender procedures Member States. The Framework Decision proclaims judicial cooperation among the Member States of the European Union, which substitutes long-lasting procedures of extradition regulated by 1995 and 1996 Conventions. Special importance for the implementation of the Framework Decision, when the location of the sought person cannot be determined, lies in the common judicial police cooperation via Europol, Interpol, S.I.Re.N.E and the Schengen Information Exchange System (SIS). The Framework Decision has been made on the basis of mutual recognition and is, as such, the first concrete measure in the field of criminal law by witch the principle of mutual recognition is applied and this is considered the basis of judicial cooperation by the European Council. This decision is based on a high level of confidence among states in the sense of mutual recognition of judicial decisions, on a direct communication of judicial authorities, the recognition process and the enforcement of judicial cooperation instruments, the exclusion of the dual criminality principle etc. Finally, this decision replaces traditional court relations with a free flow of court decisions in criminal matters; before as well as after making valid decisions in the field of freedom, safety and justice.
