Abstract
Autorsko je pravo uređeno kao najveća privatnopravna vlast koju autor ima na svojem djelu. Autorsko pravo je pravo autora u pogledu njegovog autorskog djela. Autorskim pravom ne štiti se ideja nego autorsko djelo koje je izražaj ideje, bez obzira na vrstu ili kvalitetu izražavanja. Autorsko pravo i srodna prava osiguravaju kreativnim stvarateljima i ulagačima u kreativnim industrijama upravljanje nad upotrebom njhovih autorskih djela i predmeta zaštite srodnim pravima, uz pripadajuću naknadu za takve potrebe. Vezanost područja autorskog prava i srodnih prava uz razvoj novih internetskih tehnologija, digitalizaciju autorskih djela i predmeta zaštite srodnih prava, kao i želje za stvaranjem pretpostavki za što učinkovitije ostvarivanje autorskog prava i srodnih prava čine ovo područje izuzetno dinamičnim, kako u Europskoj uniji, tako i u Republici Hrvatskoj. Europska unija je 2019. godine izglasala Direktivu o autorskim pravima na jedinstvenom digitalnom tržištu EU. Samo donošenje Direktive rezultat je prihvaćanja strategije stvaranja jedinstvenog digitalnog tržišta i dugotrajnog zakonodavnog procesa koji je počeo još 2013. godine. Digitalne tehnologije transformirale su način na koji se proizvodi, distribuira i pristupa kreativnom sadržaju. Nova direktiva ažurira pravila o autorskim pravima u skladu s tim promjenama i načinom na koji korisnici pristupaju online sadržajima. Osim toga, trenutni okvir EU-a o autorskim pravima ne bavi se problemima koji su se pojavili posljednjih godina u odnosu na distribuciju vrijednosti u online okruženju.
Abstract (english)
Copyright is regulated as the largest private law authority the author has in his work. Copyright is the copyright of the author in respect of his copyrighted work. Copyright does not protect an idea, but a copyrighted work that expresses an idea, regardless of the type or quality of expression. Copyright and related rights provide creative creators and investors in the creative industries with the management of the use of their copyrighted works and related rights, with associated compensation for such needs. The commitment of copyright and related rights to the development of new Internet technologies, the digitalisation of copyright works and the subject matter of protection of related rights, as well as the desire to create the preconditions for the effective realization of copyright and related rights make this area extremely dynamic, both in the European Union and Republic of Croatia. In 2019, the European Union adopted the Copyright Directive in the EU's Digital Single Market. The mere adoption of the Directive is the result of adopting a strategy for creating a digital single market and a lengthy legislative process that began in 2013. Digital technologies have transformed the way creative content is produced, distributed and accessed. The new directive updates the copyright rules to reflect these changes and how users access online content. In addition, the current EU copyright framework does not address the problems that have appeared in recent years with regard to the distribution of value in the online environment.
