Abstract
Menadžerski ugovor je naziv za ugovor člana uprave o obavljanju poslova unutar uprave, a odnosi se i na ugovor radu vodećih radnika, koji pripadaju u viši i srednji menadžment. Pojam menadžerski ugovor kratkotrajno se koristio kao zakonski termin.U domaćoj praksi ugovor člana uprave se samo dijelom preklapa s pojmom menadžerskog ugovora. U praksi se, s članovima uprave sklapaju i ugovori o radu i menadžerski ugovori, a također postoji i mogućnost kombinacije navedenih ugovora. Menadžerski... More ugovor se odnosi i na vodeće radnike čiji je posao organizacija i kontrola drugih radnika, a vodeći radnici se također nalaze u odnosu subordinacije s drugim radnicima i samom upravom. Sklapanje ugovora o obavljanju poslova u upravi nije obavezno, ali ono slijedi nakon imenovanja članova i prihvaćanja imenovanja. Ugovor se neće sklopiti s radnikom u koncernu, koji za svoj posao dobiva određenu naknadu, a koja je jedan od značajnih dijelova sadržaja ugovora. Oblik menadžerskog ugovora nije zakonski određen, te ugovorne strane imaju slobodu u odabiru oblika u kojem će sklopiti ugovor. Abstract (english)
Managerial contrac is a definiton of contract for a member of administration for performance of specific jobs, and it also relates to the work contract of senior employees, belonging to senior and middle managment. The concept of managerial contract was also used as a legal term. IN domestic practice, contract of administration member just partially overlaps with the concept of managerial contract. In practice, admnistartion members are concluding work contratcs, managerial contracts and... More there is also possiblity of cobination these two forms.Managerial contract also applies to leading workers, whose job is organization and control other workers, and the leading workers are also in the subordination to the other workers adn administration itself. The conlusion of a contract on the job performance is not mandatory, but it follows after the appointment of the members and acceptance of the appointment. The contract will not be concluded with a worker in the concern, who receives specific fee for his job, which is one of the significant parts of the contract content.The form of managerial contract is not legally determined, and the contractual parties have freedom to choose form of contract. Contract can be conluded in writing and verbal form, but due to consequences that may result from verbal form, it is the most acceptable to conclude a contract in writing form.
