Abstract
Žalba je redovni, devolutivan, u pravilu suspenzivan pravni lijek. Redoviti pravni lijek je onaj čije podnošenje, ili samo tok roka za njegovo podnošenje, u upravnom postupku sprječava nastupanje konačnosti akta. Devolutivan pravni lijek je onaj o čijoj osnovanosti rješava više tijelo, a ne ono koje je donijelo akt koji je pobijan pravnim lijekom. Riječ je dakle o redovnom pravnom lijeku, što znači da se podnosi protiv nepravomoćnih odluka. Stoga možemo zaključiti kako se žalba svrstava u jedno od temeljnih ljudskih prava, zajamčenog građanima najvišim pravnim aktom.
Abstract (english)
An appeal is a regular, devolutive and a usually suspending type of legal remedy. A regular remedy is one whose adoption, or whose passage of a deadline, prevents the finality of an act. A devolutive remedy is one whose basis is solved by a body superior to the body bringing the act we are disputing. It is therefore a matter of regular legal remedy, which means that it is filed against non-legitimate verdict. Therefore, we can conclude that the appeal is one of the fundamental human rights, human constitutional rights guaranteed to citizens by the highest legal act.
