Abstract
Imovinski odnosi bračnih partnera u braku i nakon rastave na području Republike Hrvatske su definirani Obiteljskim zakonom. Na bračne partnere se primjenjuju odredbe prethodno navedenog Zakona, i to samo ukoliko bračni partneri nisu imovinske odnose odredili i prethodno definirali bračnim ugovorom. Stoga, bračna stečevina je ona imovina koju su bračni partneri stekli svojim radom, odnosno imovina koja potječe iz imovine stečene radom, i to pod uvjetom da je stečena za vrijeme trajanja bračne zajednice. U današnje vrijeme, za određenje bračne stečevine potrebno je uzeti u obzir i trajanje bračne zajednice, odnosno životne zajednice bračnih drugova, a ne samog braka. U završnom radu su definirane opće odrednice koje podrazumijevaju imovinske odnose u braku i nakon rastave, te se u skladu s tim sama dioba zajedničke imovine, odnosno bračne stečevine vrši prema pravilima vlasništva.
Abstract (english)
The property relations of spouses married and after divorce in the territory of the Republic of Croatia are defined by the Family Law. The provisions of the aforementioned Act apply to the spouses only if the spouses have not defined the property relationships and have previously defined the marriage contract. Therefore, marital property is the property that the spouses have acquired through their work, that is, the property derived from the property acquired through labor, provided that it is acquired during the marriage period. Nowadays, it is necessary to take into account the duration of marital marriage, ie the life spouse of married couples, not marriage alone. In the final work, general terms are defined which imply property relations in marriage and after divorce, and accordingly the same division of joint property or marriage acquisitions is conducted according to the rules of ownership.
