Abstract
Tema ovoga rada je posebnost radnog odnosa državnih službenika. Radni odnosi državnih službenika u Republici Hrvatskoj reformiraju se dosta često. Reformi hrvatskog službeničkog sustava pristupilo se u sklopu priprema Republike Hrvatske za članstvo u EU. Glavni ciljevi te reforme bili su modernizacija državne uprave, smanjenje javnih troškova i poboljšanje upravljanja javnim sektorom. Službenički odnos je poseban radni odnos, odnosno prema Zakonu o državnim službenicima to je „ravnopravan odnos državnih službenika i države kao poslodavca“. Državni službenici obavljaju poslove iz djelokruga državnih tijela utvrđene Ustavom, zakonom ili drugim propisom donesenim na temelju Ustava i zakona. Državni službenici imaju javne ovlasti za svoj rad te svojim radom u pravnom prometu stvaraju pravne učinke koji se pripisuju državi.
Abstract (english)
The subject of this paper are the peculiarities of the working relations of the civil servants. Working relations of the civil servants in the Republic of Croatia are being reformed quite often. The reform of the Croatian civil service system has begun as part of the preparation of Croatian Republic for the membership in the EU. Main goals of this reform have been modernisation of state administration, expence reduction and improvement in public sector management. Working relation of the civil servants is quite special working relation. According to the Law on State Officials it is "an equal relationship between civil servants as employees and the state as an employer. State officials perform tasks within the scope of state bodies established by Constitutional, Statutory or other regulation adopted on the basis of Constitution and Law. Civil servants have public authority for their work and their work in legal traffic creates the legal effects attributed to the state.
