Abstract
Zaštita majčinstva važan je aspekt u radnom pravu putem kojeg zakonodavac štiti ovu kategoriju žena koje su posebno ranjive od raznih oblika diskriminacija te poboljšava njihov pravni položaj. U ovom radu autorica iznosi pravne izvore kojima je zaštićeno majčinstvo te žene počevši od zakonodavstva Europske unije pa do hrvatskog radnog prava. Posebna pozornost posvećena je radnom pravu koje štiti majke, odnosno žene, kroz razne zakone poput Zakona o radu, Zakona o rodiljnim i roditeljskim potporama, Zakona o diskriminaciji itd. Autorica u radu piše i o pravobraniteljici za ravnopravnost spolova te daje primjere iz sudske prakse iz kojih je vidljiva problematika s kojom se susreću žene odnosno majke u radnom pravu. Središnji dio rada je posvećen zakonskoj regulativi i pravnoj zaštiti majčinstva u hrvatskom radnom pravu koje kroz razne institute štiti majčinstvo.
Abstract (english)
Protection of motherhood is an important aspect in the labor law through which the legislator protects this category of women who are especially wourneable through many types of discrimination and improves their legal position. In this paper the author presents legal sources which protect motherhood and women starting from legislation of the European Union to the Croatian labor law. Special attention is devoted to labor law which protects mothers, or women, through many laws such as Labor law, The law on maternity and parental benefits, Discrimination law etc. The author also writes about ombudsman for gender equality and gives examples from jurisprudence from which it is possible to see the problems women or mothers face in labor law. Central part of this paper is focused on the legislation and legal protection of motherhood in Croatian labor law which protects motherhood through many institutes.
