Abstract
Predmet ovog rada je prekršajno pravo, odnos između prekršajnog i kaznenog prava, definiranje prekršaja te opisivanje prekršajnopravnih sankcija. Prekršajnopravne sankcije propisuju se za sva ponašanja kojima je moguće ugroziti javni poredak, društvenu disciplinu te društvene vrijednosti. Prekršaji pripadaju kažnjivim djelima, a propisani su zakonom. Svrha propisivanja i primjene prekršajnopravnih sankcija je sprječavanje pojedinaca da počine prekršaj te da poštuju pravni sustav. U radu se opisuju prekršaji, vrijeme i mjesto počinjenja prekršaja, sustav sankcija te vrste prekršajnopravnih sankcija. Nadalje, prikazuje se uloga kažnjavanja te se iznose različite vrste kazni. Mjere upozorenja, zaštitne mjere te odgojne mjere čine jedinstvenu cjelinu prekršajnopravnih funkcija te kao takve čine instrumente kojima se uređuje prekršajna odgovornost.
Abstract (english)
The subject of this work is misdemeanor law, relationship between misdemeanor law and criminal law, definition of misdemeanor and the description of misdemeanor sanctions. The misdemeanor sanctions are prescribed for all behavior that can endanger the public order, social discipline and social values. Misdemeanors belong to criminal acts that are regulated by the law. The purpose of prescribing and the application of misdemeanor sanctions is to prevent individuals from committing misdemeanor and to respect the legal system. In this paper are described misdemeanors, time and place of commited misdemeanor, system of sanctions and varieties of misdemeanor sanction. Furthermore, this paper shows the role of punishments and different types of penalties. Warning precautions, protective precautions and educational precautions constitute a whole unity of misdemeanor function and they are instruments with whom misdemeanor responsibility is regulated.
