Abstract
Tema ovog rada je analiza Zakona o nasljeđivanju u Republici Hrvatskoj te se nastojalo sagledati zakon u kontekstu relativno nedavnih promjena po osnovu drugih zakona (Zakona o životnom partnerstvu osoba istog spola) i akata EU koji su preuzeti u hrvatskom zakonodavstvu (konkretno Uredbe br. 650/2012 o nasljeđivanju koja je preuzeta Zakonom o provedbi Uredbe (EU) 650/2012). Pored sažetog prikaza temelja nasljeđivanja, zakonskih nasljednika ostavitelja te osnovnih pojmova vezanih za nasljeđe i ostavinski postupak, veliki dio rada posvećen je novinama koje u zakon o nasljeđivanju donosi provedba Uredbe (EU) 650/2012, ali i promjene do kojih je došlo temeljem Zakona o životnom partnerstvu osoba istog spola. Namjera je na sažet i koncizan način prikazati ključne značajke Zakona o nasljeđivanju u Republici Hrvaatskoj, te tako omogućiti pregledno, sažeto promatranje odnosno dalje proučavanje ove tematike.
Abstract (english)
A topic of this paper is an analysis of the Law on Succession in the Republic of Croatia and the intention was to provide an overview of the Law in the context of relatively recent changes based on other laws (Law on Same-Sex Life Partnership) and EU acts which were integrated in Croatian legislation (specifically EU Regulation 650/2012 on International Successions). Besides a brief presentation of the foundations of succession, legal successors of the deceased and basic terminology related to succession and probate proceedings, a large portion of the paper is dedicated to the new elements introduced in the Law on Succession through the EU Regulation and changes occurring due to the Law on Same-Sex Life Partnership. The intention was to provide summarized and precise presentation of key elements of the Law on Inheritance in the Republic of Croatia, thus enable focused examination i.e. further exploring of this topic.
