Abstract
Stečajni postupak se može definirati kao zasebna vrsta izvanparničnoga postupka koja se provodi sa svrhom skupnog podmirenja svih vjerovnika stečajnoga dužnika i to unovčenjem njegove imovine te podjelom prikupljenih sredstava vjerovnicima. Stečajni postupak se provodi radi skupnoga namirenja vjerovnika stečajnoga dužnika, unovčenjem njegove imovine i podjelom prikupljenih sredstava vjerovnicima. Predstečajni postupak je posebna vrsta izvanparničnoga postupka koji se provodi radi uređivanja pravnoga položaja dužnika i njegova odnosa prema vjerovnicima. Sklopljena predstečajna nagodba ima snagu i pravne učinke ovršne isprave za sve vjerovnike čije su tražbine utvrđene.
Abstract (english)
Bankruptcy proceedings can be defined as a separate type of extra-judicial proceedings conducted for the purpose of collective settlement of all of creditors and liquidation of its assets and their distribution among the creditors. Bankruptcy proceedings are carried out in order to jointly settlement of creditors, the liquidation of its assets and their distribution among the creditors. Pre-bankruptcy proceedings is a special type of extra-judicial procedure which is carried out for editing the legal position of the debtor and its relationship to creditors. Folded the pre-agreement has the force and legal effect of an execution document for all creditors whose claims have been established.
