One of the biggest problems of the Croatian legal system are excessively long duration of judicial and administrative proceedings, and also a delay in the implementation of laws and regulations can lead to impotence citizens before the legal system and loss of self-rule of law. As in most legal systems, as well as in the Croatian legal system, there is a delay in the court proceedings, so the 1997 European Convention has become part of the internal legal order of the Republic of Croatian and began her binding provision Convention, entitled 'Right to a fair trial ''. As part of a broader concept of omission administration, there is the concept of failure, which is legally relevant and legally sanctioned omission, but that occurs when management does nothing in certain time frames in order to achieve its legally standardized obligation to commit. Accordingly, administrative silence is the failure of the competent public administration that in certain periods prescribed by law to issue and deliver the party solution, and it often leads to the failure of certain legal consequences. To legislator in Croatia secured system of legal protection from administrative silence, still serves legal structures. This system is based on the opportunities and the right for appeal or filing a complaint with the Administrative Court.
